Often in court cases and jurisprudence related to special education, the problem at hand relates to the "free and appropriate public education" (FAPE) clause of the Individuals With Disabilities Education Act (IDEA, last revised 1994). What is FAPE? How do schools ensure it? Does it require/ensure that medical conditions will also be addressed by school systems? Are school systems liable for private school fees if they cannot provide FAPE? How does successful or unsuccessful writing of Individualized Education Plans (IEP's)? These are the questions that dominate special education school law.
